Death penalty if the victim dies

Kolkata: The West Bengal Legislative Assembly unanimously passed the anti-corruption ‘Aparajita’ Bill of the Grassroots Congress’ Mamata Banerjee government today. By introducing such a bill, West Bengal has become the first state in the country to amend the central law related to crimes like misdemeanor, prostitution and child sexual abuse. The bill will now be sent to West Bengal Governor CV Anand Bose and then to President Draupadi Murmu for their approval.

The Chief Minister termed this bill as a historic and exemplary bill. Chief Minister Mamata said that this bill is a tribute to the 31-year-old trainee doctor who was a victim of violence and murder at the Argi Kar Medical College and Hospital last month. The said bill has been named the Impeachment Women and Children (West Bengal Criminal Law and Amendment) Bill, 2024. It has a provision of death penalty if the woman accused of misdemeanor and sexual offense  dies or falls into a coma.

A misdemeanor conviction carries a maximum sentence of life in prison without parole. During the discussion on the bill in the special session of the West Bengal Assembly, Chief Minister Mamata said, “The police arrested the main accused within 12 hours in the case of Arji Kar Medical College and Hospital. I asked the police to go to the fast track court and file an application for hanging.” But the case was handed over to the CBI. Now we are demanding justice from CBI. We have been demanding death penalty from the beginning,” said Mamata.

Mamata said that the aim of the impunity bill is to speed up investigation, speedy justice and increase punishment. The West Bengal Law Minister introduced the Bill in the Assembly. BJP has supported this bill. “We support the anti-mischief bill,” said leader of the opposition Shubhendu Adhikari. However, he was of the opinion that the government has introduced this bill to divert attention from public unrest and protests. Opposition leader Shubhendu proposed seven amendments to the bill and demanded immediate implementation of the law.
